How does the court make time-sharing decisions?
As mentioned, the court will attempt to balance the rights of each parent with the best interests of the child. The courts typically default to a 50/50 time-sharing agreement; however, in order for there to be an unequal time-sharing plan, the court will look at the best interest of the child.
This agreement will be based upon such factors as:
- The parent who will provide for frequent and continuing contact
- Each parent's mental and physical health
- Each parent's financial situation
- The living arrangements of each parent
- The willingness of each parent to cooperate with the other parent
